Use this worksheet to identify records you already lawfully possess, records that may disappear, and systems that may hold information you cannot access directly.
Preserve first
- Decision letters and notices
- Paystubs and schedules
- Performance reviews and warnings
- Complaints and accommodation requests
- Policies and job descriptions
- Agency filings and portal confirmations
- Texts, emails, and messages relevant to the issue
- Your own contemporaneous notes
Do not take what you are not entitled to possess
Do not copy privileged communications, trade secrets, confidential customer records, another worker's medical information, or restricted employer data merely because it might be useful.
Record missing evidence
Sometimes the most important evidence is known but unavailable: a time-edit audit trail, applicant score, ranking matrix, investigation notes, or decision-maker email. Record what you believe exists, why it matters, and who likely controls it.
