A mixed case combines a discrimination allegation with a personnel action that is appealable to the Merit Systems Protection Board. It is one of the easiest federal employment areas to mishandle because EEO and MSPB procedures overlap without simply merging.

First formal filing can matter

A covered employee may have a choice between filing a mixed-case complaint with the agency's EEO office or a mixed-case appeal with the MSPB. The election rules make sequence important. EEO counseling itself is not necessarily the formal election, but a later formal filing can be.

Confirm MSPB jurisdiction before assuming the case is mixed

A discrimination allegation does not make every federal employment dispute a mixed case. The underlying personnel action must be one the MSPB can hear for that employee under the applicable law.

Keep both records organized

Preserve the EEO counseling record, formal complaint, MSPB appeal, agency notices, final decisions, proof of receipt, and any jurisdictional order. If MSPB dismisses for lack of jurisdiction, the next EEO step can depend on the posture and timing.

Do not use a generic deadline chart

Mixed cases contain short and route-specific time periods. Use the actual agency/MSPB notice and current official regulations or guidance. When the forum is uncertain, get competent advice quickly rather than trying multiple filings and hoping one preserves the rest.
