Automated Hiring and Applicant Screening

Locate the stage, tool, data, rule, accommodation path, and human review that shaped the decision.

Locate the stage, tool, data, rule, accommodation path, and human review that shaped the decision.

Applicants often receive a generic rejection after moving through several invisible filters. The first task is to locate the screen-out point: a knockout question, resume parser, assessment, video tool, identity check, background process, score threshold, or human review shaped by an automated ranking.

Preserve The Application Path While It Still Exists

Save the job posting, application answers, confirmations, assessment instructions, accessibility notices, accommodation request, score or reason code, rejection notice, and timestamps. The employer or vendor may later change the interface.

Locate The Decision Point

An application may be rejected by a knockout question, resume parser, assessment, video tool, identity check, background process, ranking threshold, or human review informed by a score. Preserve the sequence and every notice because later pages may not reveal which step caused rejection. The employer may not possess all vendor data, but responsibility cannot be analyzed without mapping who selected the tool, configured it, received output, and made the final decision.

Test Relevance And Accessibility

A model can use criteria that correlate with protected status or disadvantage disabled applicants even when no explicit protected field is used. Ask whether inputs measure the job, whether alternatives or accommodations were available, and whether the tool was validated for the actual role and population. An inaccessible assessment, timed task, facial or speech analysis, or identity process can create separate barriers.

Build A Defensible Comparison

An individual applicant may know little about others. Public materials, job postings, communications, repeated applications, audit reports, government inquiries, or aggregate data can provide context. Avoid asserting a statistical conclusion from isolated anecdotes. Qualifications must be measured against the criteria actually used, not only the applicant's belief that they were strong.

Records Of The Application Path

  • Job posting and version.
  • Application answers and confirmation.
  • Assessment instructions, accessibility notices, and accommodation request.
  • Scores, reason codes, rejection notices, and timestamps.
  • Vendor identity and employer disclosures.
  • Records of human review or reconsideration.

Where The Analysis Can Break Down

  • A rejection alone does not establish discrimination.
  • Employers may use lawful job-related screening and background processes.
  • Applicants may not be entitled to all proprietary model information at the pre-claim stage.
  • State and local automated-employment laws vary.

What To Do Next

  1. 1. Save the complete application path and screenshots.
  2. 2. Record any accommodation need and response.
  3. 3. Identify the precise screen-out stage.
  4. 4. Use official agency resources promptly if a filing deadline may apply.
